  4. Employer compliance fee

English

A lot of clients have been asking us, especially Gurudwara committees and community organizations: "Can we bring a Granthi or Ragi from India without an LMIA?" or "A charity wants to hire me. Is there a special work permit for that?"

The short answer is yes. Canada has two LMIA-exempt work permits for exactly these situations:

C50 for religious work and C51 for charitable work.

They sound similar, but they cover very different jobs, and applying under the wrong one can lead to a refusal.

Let's break it down in simple terms.

🙏 What Is a C50 Work Permit?

C50 lets a religious organization hire a foreign worker for religious work without an LMIA.

The most important rule: IRCC looks at the job, not just the employer. Working at a Gurudwara, temple, church or mosque is not enough on its own. The main duties must be religious, such as:

  • Leading religious services and observances

  • Teaching the faith or the scriptures

  • Upholding the faith's spiritual practices

  • Promoting the faith and its spiritual teachings

Scenario: A Gurudwara in Surrey wants to hire a Ragi to perform Kirtan at daily services. If the main duties are religious, the job can fit under C50. But if the same Gurudwara wants to hire an office manager or a bookkeeper, that job is not religious work and does not qualify, even though the employer is a Gurudwara.

🤝 What Is a C51 Work Permit?

C51 lets a charitable organization hire a foreign worker for charitable work without an LMIA. The work itself must help people in need or serve the community.

Examples of charitable work include:

  • Cooking and serving meals at a homeless shelter

  • Running classes for low-income families

  • Providing round-the-clock care in a group home for people with disabilities

  • Building homes for families in need

Scenario: A non-profit shelter in Abbotsford wants to hire a cook to prepare meals for homeless residents. That is charitable work and can fit under C51. An administrative or office role at the same charity generally would not.

🏢 Which Employers Qualify?

For C50 (religious work), the employer must be a genuine religious organization. The employer must:

  1. Submit a job offer through IRCC's Employer Portal using code C50

  2. Clearly explain why the duties are religious

  3. Pay at least the local minimum wage if the job is paid

  4. Pay the employer compliance fee, unless the job is unpaid

For C51 (charitable work), the employer must be a charity or non-profit with a charitable purpose. Being a CRA-registered charity helps, but it is not strictly required. A non-registered organization must show that its purpose is charitable, such as relieving poverty, advancing education, advancing religion or benefiting the community. IRCC may ask for incorporation documents, annual reports, letters of support and proof of who the organization serves. The job offer also goes through the Employer Portal, and the compliance fee applies unless the work is unpaid.

📋 What Does the Worker Need?

  • The job offer number from the employer

  • Proof of education and experience for the role

  • A valid passport

  • Biometrics

The work permit is usually issued for the length of the job offer, but never past the passport's expiry date.

❓ Common Questions

Q. I help at the Gurudwara langar every weekend. Do I need a work permit? Generally, no. That is volunteering, not work. A work permit is needed when the role is a real job that a Canadian or permanent resident could otherwise be hired to do.

Q. What if the job is unpaid? Do I still need a permit?

Yes, if the role is a real job. However, if you receive nothing more than a small living stipend or free room and board, you may not have to pay the work permit fee, and the employer may not have to pay the compliance fee.

Q. Does unpaid religious work count as Canadian work experience for PR?

No. Unpaid religious work does not count towards the Canadian Experience Class.

Q. Does every religious leader need a work permit?

Not always. Some religious leaders are exempt from needing a work permit for certain religious duties. They may still choose a C50 permit, for example to stay longer or to access government services that require a work permit.

⚠️ Common Mistakes We See

  1. Applying under C50 for a job that is really administrative, such as a Gurdwara office manager

  2. A job offer that does not clearly explain the religious or charitable duties

  3. Missing proof that the organization is genuinely religious or charitable

  4. Treating a real job as "volunteering" and skipping the work permit altogether

✅ Key Takeaways

  • ✅ C50 is for religious work; C51 is for charitable work. Neither needs an LMIA.

  • ✅ IRCC looks at the duties, not just the name of the employer.

  • ✅ Office and admin jobs usually don't qualify under either code.
