Spousal Open Work Permit Under the Family Class: What Changed in January 2025
If you are sponsoring your spouse or common-law partner to become a permanent resident of Canada, they may be able to get a Spousal Open Work Permit (SOWP). This lets them work for almost any employer in Canada while your sponsorship application is being processed.
In January 2025, the Canadian government (IRCC) made big changes to open work permits for family members.
Many people are now confused and worried: does this affect spousal sponsorship too? The short answer is no — but let's break it down in simple terms.
What Is the Spousal Open Work Permit?
This work permit is for a spouse, common-law partner, or conjugal partner who is living in Canada and being sponsored by their Canadian partner for permanent residence. It is often called the "Family Class" open work permit, and it has been available in its current form since May 10, 2023.
To qualify, you must:
Be living in Canada with your sponsor, in a genuine relationship
Be included in a permanent residence application, and already have your Acknowledgement of Receipt (AOR) letter confirming IRCC is processing that application
Have valid legal status in Canada — a valid visitor record, study permit, work permit, or temporary resident permit; or be in "maintained status" (sometimes called implied status); or be eligible to restore your status
You apply through your IRCC online account. When filling out the work permit form, you list your permit type as "Open Work Permit," your job title as "SCLPC FC OWP," and your description as "SCLPC FC applicant in Canada public policy." You will need to upload your AOR letter and proof of your valid status.
If your permanent residence application is refused, withdrawn, or returned, you can no longer use this permit.
What Actually Changed on January 21, 2025
Starting January 21, 2025, IRCC tightened the rules for a different group: open work permits for the family members of foreign workers and international students (people who are not yet in the permanent residence process). Here is what changed for them:
Spouses of international students can only get a family open work permit if the student is in a master's program of 16 months or longer, a doctoral program, or certain professional programs.
Spouses of foreign workers can only get one if the worker's job falls under TEER 0 or TEER 1 (higher-skilled occupations), or certain TEER 2 or TEER 3 jobs in industries facing labour shortages, such as healthcare, construction, sciences, education, and a few others. The worker must also have at least 16 months left on their own work permit.
Dependent children of foreign workers can no longer get an open work permit at all under this rule.
If a family member already had an open work permit before January 21, 2025, it stays valid. They may also be able to renew it later if they still meet the rules that applied when they first got it.
Why Family Class Sponsorship Is Not Affected
This is the most important part. IRCC has confirmed that spouses and common-law partners being sponsored for permanent residence by their Canadian partner are exempt from the January 2025 changes — as long as they already hold valid temporary status in Canada. IRCC's own notice says people "transitioning to permanent residence" are not impacted by the new rules.
So if you are sponsoring your spouse under the Family Class:
You do not need to worry about TEER job categories
You do not need to worry about the 16-month permit rule
Your spouse still just needs valid (or restorable) status in Canada, an AOR letter, and a genuine relationship with you
Nothing about this part of the process changed in January 2025. The requirement to hold valid status has actually been in place since May 2023, well before the 2025 changes.
Simple Summary
The January 2025 changes affect spouses of foreign workers and international students — not spouses being sponsored under Family Class.
Family Class spousal open work permits still follow the same rules they have followed since May 2023.
The main requirement to remember: keep your temporary status valid in Canada, because there is no exemption from this rule.
If your status lapses and cannot be restored, you will not be able to get this work permit — so it is important to apply and act early.

ਜਨਵਰੀ 2025 ਵਿੱਚ, ਕੈਨੇਡਾ ਸਰਕਾਰ (IRCC) ਨੇ ਫੈਮਿਲੀ ਮੈਂਬਰਾਂ ਦੇ ਓਪਨ ਵਰਕ ਪਰਮਿਟਾਂ ਵਿੱਚ ਵੱਡੇ ਬਦਲਾਅ ਕੀਤੇ ਸਨ। ਇਸ ਕਰਕੇ ਬਹੁਤ ਸਾਰੇ ਲੋਕ ਉਲਝਣ ਵਿੱਚ ਹਨ ਕਿ ਕੀ ਇਹ ਬਦਲਾਅ ਸਪਾਊਸਲ ਸਪਾਂਸਰਸ਼ਿਪ ਨੂੰ ਵੀ ਪ੍ਰਭਾਵਿਤ ਕਰਦੇ ਹਨ। ਛੋਟਾ ਜਵਾਬ ਹੈ ਨਹੀਂ — ਪਰ ਆਓ ਇਸਨੂੰ ਸੌਖੇ ਸ਼ਬਦਾਂ ਵਿੱਚ ਸਮਝੀਏ।
ਸਪਾਊਸਲ ਓਪਨ ਵਰਕ ਪਰਮਿਟ ਕੀ ਹੈ?
ਇਹ ਵਰਕ ਪਰਮਿਟ ਉਸ ਪਤੀ/ਪਤਨੀ, ਕਾਮਨ-ਲਾਅ ਪਾਰਟਨਰ, ਜਾਂ ਕੌਂਜੂਗਲ ਪਾਰਟਨਰ ਲਈ ਹੈ ਜੋ ਕੈਨੇਡਾ ਵਿੱਚ ਰਹਿ ਰਹੇ/ਰਹੀਆਂ ਹਨ ਅਤੇ ਆਪਣੇ ਕੈਨੇਡੀਅਨ ਪਾਰਟਨਰ ਵੱਲੋਂ ਪਰਮਾਨੈਂਟ ਰੈਜ਼ੀਡੈਂਸੀ ਲਈ ਸਪਾਂਸਰ ਕੀਤੇ/ਕੀਤੀਆਂ ਜਾ ਰਹੇ/ਰਹੀਆਂ ਹਨ। ਇਸਨੂੰ ਅਕਸਰ "ਫੈਮਿਲੀ ਕਲਾਸ" ਓਪਨ ਵਰਕ ਪਰਮਿਟ ਕਿਹਾ ਜਾਂਦਾ ਹੈ, ਅਤੇ ਇਹ ਆਪਣੇ ਮੌਜੂਦਾ ਰੂਪ ਵਿੱਚ 10 ਮਈ, 2023 ਤੋਂ ਲਾਗੂ ਹੈ।

21 ਜਨਵਰੀ, 2025 ਨੂੰ ਅਸਲ ਵਿੱਚ ਕੀ ਬਦਲਿਆ
21 ਜਨਵਰੀ, 2025 ਤੋਂ, IRCC ਨੇ ਇੱਕ ਵੱਖਰੇ ਗਰੁੱਪ ਲਈ ਨਿਯਮ ਸਖ਼ਤ ਕਰ ਦਿੱਤੇ: ਫਾਰੇਨ ਵਰਕਰਾਂ ਅਤੇ ਇੰਟਰਨੈਸ਼ਨਲ ਸਟੂਡੈਂਟਸ ਦੇ ਫੈਮਿਲੀ ਮੈਂਬਰਾਂ ਦੇ ਓਪਨ ਵਰਕ ਪਰਮਿਟ (ਯਾਨੀ ਉਹ ਲੋਕ ਜੋ ਅਜੇ ਪਰਮਾਨੈਂਟ ਰੈਜ਼ੀਡੈਂਸੀ ਪ੍ਰੋਸੈਸ ਵਿੱਚ ਨਹੀਂ ਹਨ)। ਉਹਨਾਂ ਲਈ ਕੀ ਬਦਲਿਆ, ਇਹ ਰਿਹਾ:

ਫਾਰੇਨ ਵਰਕਰਾਂ ਦੇ ਪਤੀ/ਪਤਨੀ ਸਿਰਫ਼ ਉਦੋਂ ਹੀ ਲੈ ਸਕਦੇ ਹਨ ਜੇ ਵਰਕਰ ਦੀ ਨੌਕਰੀ TEER 0 ਜਾਂ TEER 1 (ਉੱਚ-ਹੁਨਰ ਵਾਲੀਆਂ ਨੌਕਰੀਆਂ) ਵਿੱਚ ਆਉਂਦੀ ਹੈ, ਜਾਂ ਕੁਝ ਖ਼ਾਸ TEER 2 ਜਾਂ TEER 3 ਨੌਕਰੀਆਂ ਵਿੱਚ ਜੋ ਲੇਬਰ ਦੀ ਘਾਟ ਵਾਲੇ ਸੈਕਟਰਾਂ (ਜਿਵੇਂ ਹੈਲਥਕੇਅਰ, ਕੰਸਟ੍ਰਕਸ਼ਨ, ਸਾਇੰਸਿਜ਼, ਐਜੂਕੇਸ਼ਨ, ਅਤੇ ਕੁਝ ਹੋਰ) ਨਾਲ ਸਬੰਧਤ ਹਨ। ਵਰਕਰ ਕੋਲ ਆਪਣੇ ਵਰਕ ਪਰਮਿਟ ਦੇ ਘੱਟੋ-ਘੱਟ 16 ਮਹੀਨੇ ਬਾਕੀ ਵੀ ਹੋਣੇ ਚਾਹੀਦੇ ਹਨ।
ਫਾਰੇਨ ਵਰਕਰਾਂ ਦੇ ਡਿਪੈਂਡੈਂਟ ਬੱਚੇ ਹੁਣ ਇਸ ਨਿਯਮ ਅਧੀਨ ਬਿਲਕੁਲ ਵੀ ਓਪਨ ਵਰਕ ਪਰਮਿਟ ਨਹੀਂ ਲੈ ਸਕਦੇ।
ਜੇ ਕਿਸੇ ਫੈਮਿਲੀ ਮੈਂਬਰ ਕੋਲ 21 ਜਨਵਰੀ, 2025 ਤੋਂ ਪਹਿਲਾਂ ਹੀ ਓਪਨ ਵਰਕ ਪਰਮਿਟ ਸੀ, ਤਾਂ ਉਹ ਵੈਧ ਰਹਿੰਦਾ ਹੈ। ਉਹ ਬਾਅਦ ਵਿੱਚ ਇਸਨੂੰ ਰੀਨਿਊ ਵੀ ਕਰਵਾ ਸਕਦੇ ਹਨ, ਜੇ ਉਹ ਅਜੇ ਵੀ ਉਹਨਾਂ ਨਿਯਮਾਂ ਨੂੰ ਪੂਰਾ ਕਰਦੇ ਹਨ ਜੋ ਉਸ ਵੇਲੇ ਲਾਗੂ ਸਨ ਜਦੋਂ ਉਹਨਾਂ ਨੂੰ ਪਹਿਲੀ ਵਾਰ ਪਰਮਿਟ ਮਿਲਿਆ ਸੀ।
ਫੈਮਿਲੀ ਕਲਾਸ ਸਪਾਂਸਰਸ਼ਿਪ ਪ੍ਰਭਾਵਿਤ ਕਿਉਂ ਨਹੀਂ ਹੋਈ
ਇਹ ਸਭ ਤੋਂ ਜ਼ਰੂਰੀ ਗੱਲ ਹੈ। IRCC ਨੇ ਪੁਸ਼ਟੀ ਕੀਤੀ ਹੈ ਕਿ ਜੋ ਪਤੀ/ਪਤਨੀ ਅਤੇ ਕਾਮਨ-ਲਾਅ ਪਾਰਟਨਰ ਆਪਣੇ ਕੈਨੇਡੀਅਨ ਪਾਰਟਨਰ ਵੱਲੋਂ ਪਰਮਾਨੈਂਟ ਰੈਜ਼ੀਡੈਂਸੀ ਲਈ ਸਪਾਂਸਰ ਕੀਤੇ/ਕੀਤੀਆਂ ਜਾ ਰਹੇ/ਰਹੀਆਂ ਹਨ, ਉਹ ਜਨਵਰੀ 2025 ਦੇ ਬਦਲਾਵਾਂ ਤੋਂ ਛੋਟ (exempt) ਹਨ — ਜਿੰਨਾ ਚਿਰ ਉਹਨਾਂ ਕੋਲ ਪਹਿਲਾਂ ਹੀ ਕੈਨੇਡਾ ਵਿੱਚ ਵੈਧ ਟੈਂਪਰੇਰੀ ਸਟੇਟਸ ਹੈ। IRCC ਦੇ ਆਪਣੇ ਨੋਟਿਸ ਵਿੱਚ ਕਿਹਾ ਗਿਆ ਹੈ ਕਿ ਜੋ ਲੋਕ "ਪਰਮਾਨੈਂਟ ਰੈਜ਼ੀਡੈਂਸੀ ਵੱਲ ਜਾ ਰਹੇ ਹਨ" (transitioning to permanent residence), ਉਹ ਨਵੇਂ ਨਿਯਮਾਂ ਤੋਂ ਪ੍ਰਭਾਵਿਤ ਨਹੀਂ ਹਨ।
ਇਸ ਲਈ ਜੇ ਤੁਸੀਂ ਫੈਮਿਲੀ ਕਲਾਸ ਅਧੀਨ ਆਪਣੇ ਪਤੀ/ਪਤਨੀ ਨੂੰ ਸਪਾਂਸਰ ਕਰ ਰਹੇ ਹੋ:
ਤੁਹਾਨੂੰ TEER ਜੌਬ ਕੈਟਾਗਰੀਆਂ ਬਾਰੇ ਚਿੰਤਾ ਕਰਨ ਦੀ ਲੋੜ ਨਹੀਂ ਹੈ
ਤੁਹਾਨੂੰ 16-ਮਹੀਨੇ ਦੇ ਪਰਮਿਟ ਨਿਯਮ ਬਾਰੇ ਚਿੰਤਾ ਕਰਨ ਦੀ ਲੋੜ ਨਹੀਂ ਹੈ
ਤੁਹਾਡੇ ਪਤੀ/ਪਤਨੀ ਨੂੰ ਸਿਰਫ਼ ਕੈਨੇਡਾ ਵਿੱਚ ਵੈਧ (ਜਾਂ ਬਹਾਲ ਹੋਣ ਯੋਗ) ਸਟੇਟਸ, ਇੱਕ AOR ਲੈਟਰ, ਅਤੇ ਤੁਹਾਡੇ ਨਾਲ ਇੱਕ ਸੱਚੇ ਰਿਸ਼ਤੇ ਦੀ ਲੋੜ ਹੈ
ਇਸ ਹਿੱਸੇ ਬਾਰੇ ਜਨਵਰੀ 2025 ਵਿੱਚ ਕੁਝ ਵੀ ਨਹੀਂ ਬਦਲਿਆ। ਵੈਧ ਸਟੇਟਸ ਰੱਖਣ ਦੀ ਸ਼ਰਤ ਅਸਲ ਵਿੱਚ ਮਈ 2023 ਤੋਂ ਹੀ ਲਾਗੂ ਹੈ, ਯਾਨੀ 2025 ਦੇ ਬਦਲਾਵਾਂ ਤੋਂ ਬਹੁਤ ਪਹਿਲਾਂ ਤੋਂ।
ਸੌਖੇ ਸ਼ਬਦਾਂ ਵਿੱਚ ਸਾਰ
ਜਨਵਰੀ 2025 ਦੇ ਬਦਲਾਅ ਫਾਰੇਨ ਵਰਕਰਾਂ ਅਤੇ ਇੰਟਰਨੈਸ਼ਨਲ ਸਟੂਡੈਂਟਸ ਦੇ ਪਤੀ/ਪਤਨੀ ਨੂੰ ਪ੍ਰਭਾਵਿਤ ਕਰਦੇ ਹਨ — ਫੈਮਿਲੀ ਕਲਾਸ ਅਧੀਨ ਸਪਾਂਸਰ ਹੋਣ ਵਾਲੇ ਪਤੀ/ਪਤਨੀ ਨੂੰ ਨਹੀਂ।
ਫੈਮਿਲੀ ਕਲਾਸ ਸਪਾਊਸਲ ਓਪਨ ਵਰਕ ਪਰਮਿਟ ਅਜੇ ਵੀ ਉਹੀ ਨਿਯਮ ਮੰਨਦਾ ਹੈ ਜੋ ਮਈ 2023 ਤੋਂ ਲਾਗੂ ਹਨ।
ਯਾਦ ਰੱਖਣ ਵਾਲੀ ਸਭ ਤੋਂ ਜ਼ਰੂਰੀ ਗੱਲ: ਕੈਨੇਡਾ ਵਿੱਚ ਆਪਣਾ ਟੈਂਪਰੇਰੀ ਸਟੇਟਸ ਵੈਧ ਰੱਖੋ, ਕਿਉਂਕਿ ਇਸ ਨਿਯਮ ਤੋਂ ਕੋਈ ਛੋਟ ਨਹੀਂ ਹੈ।
ਜੇ ਤੁਹਾਡਾ ਸਟੇਟਸ ਖ਼ਤਮ ਹੋ ਜਾਂਦਾ ਹੈ ਅਤੇ ਬਹਾਲ ਨਹੀਂ ਹੋ ਸਕਦਾ, ਤਾਂ ਤੁਹਾਨੂੰ ਇਹ ਵਰਕ ਪਰਮਿਟ ਨਹੀਂ ਮਿਲੇਗਾ — ਇਸ ਲਈ ਜਲਦੀ ਅਪਲਾਈ ਕਰਨਾ ਅਤੇ ਸਮੇਂ ਸਿਰ ਕਦਮ ਚੁੱਕਣਾ ਬਹੁਤ ਜ਼ਰੂਰੀ ਹੈ।
